About the Property Owners' Association Act and "Disclosure"

According to the CODE OF VIRGINIA TITLE 55. Property and Conveyances.  Chapter 26: Virginia Property Owners' Association Act (POA), property owners and homeowner associations are required to disclose a property's standing according to the HOA covenants and rules and regulations to any contract purchaser.


§55-511. Contract disclosure statement; right of cancellation.
A. Subject to the provisions of subsection F of § 55-512, a person selling a lot shall disclose in the contract that (i) the lot is located within a development which is subject to the Virginia Property Owners' Association Act, (ii) the Act requires the seller to obtain from the property owners' association an association disclosure packet and provide it to the purchaser, (iii) the purchaser may cancel the contract within three days after receiving the association disclosure packet or being notified that the association disclosure packet will not be available, and (iv) the right to receive the association disclosure packet and the right to cancel the contract are waived conclusively if not exercised before settlement.

Helpful Tips:  The POAA allows associations 14 days to provide the packet, which is valid for 30 days.  Please request your packet accordingly.

What Does the POAA Mean To Me?

What the Property Owners Association Act (POAA) means to you is that YOU, the homeowner or seller, must request a DISCLOSURE PACKET from the homeowner association.  The packet is to be given to your purchaser.  By doing this, you have DISCLOSED to the purchaser the status of your property in the eyes of the Homeowner Association.  So that any violations or assessment delinquencies are known to them prior to taking ownership.

Step by Step:  The Disclosure Process

What is the disclosure process?
1. The owner or owner's agent must complete the request form and pay fee.
2. LRRHOA staff member inspects the exterior of the home and property.
3. Maintenance and/or architectural violations, and both authorized and unauthorized modifications or additions are noted.
4. Current status of the owners assessment account is verified and is noted either paid in full, delinquent or balance due.
5. These reports become a part of the disclosure packet.
6. The disclosure packet also includes the Association's Architectural and Maintenance standards, Association Rules and Policies, Covenants and Bylaws, Supplementary declarations, current budget, statement of pending lawsuits, and insurance information.
7. The owner or owner's agent is contacted to pick up and sign for the packet.

Property Inspection
During disclosure inspections we have found that the following are the most common violations noted.  We have listed them here so that you may have the opportunity to correct some violations before the inspection.


Common Violations Noted During Disclosure Inspection

(including, but, not limited to):

n Faded, deteriorated, chipped or peeling paint on wood trim (including roofline).
n Damaged, deteriorated, chipping or dirty shutters and/or siding.
n Window muntins (grids) broken or missing.
n Roof shingles crumbling.
n Gutters/downspouts in disrepair, rusted or dirty.
n Damaged or chipping cement foundations and/or black parge lines visible.
n Window screens torn or frames in disrepair.
n Bare areas on the property with no grass or ground cover.
n Fences/gates in disrepair, warped or leaning.
n Storage sheds in disrepair or in need of paint.
n Erosion of entry stoops and steps.
n Walkways crumbling or in disrepair.
n Exterior lighting fixtures missing/broken.
n Entry railings chipping or in disrepair.
n Drainage hoses visible.
n Grass tall and not being maintained.
n Weeds in landscaping beds and in need of mulching.
n Shrubbery in need of trimming/dead trees or shrubbery in need of removal.
n Miscellaneous items being stored in public view on the property.
n Chimney caps/vents in disrepair or rusting.
n Decks/stairs in disrepair or warped.
n Exterior changes or additions made to the property that do not meet pre-approved ARB criteria or have not had prior approval of the Architectural Review Board.

How To Request A Packet

To request the packet
- print and complete the Disclosure Packet & Estoppel Certificate Request Form below and mail or bring with a check for $100.00 to Little Rocky Run Homeowners Association, 6201 Sandstone Way, Clifton, VA 20124.

Please make check payable to LRR HOA.
Payment is required prior to documents being processed. Virginia State Law governing the Property Owners' Disclosure Act, the Association is allowed fourteen (14) calendar days to provide the documents to the seller or seller's agent.
